Well at least as long as the email is passing USA some how. For example if you using Hotmail.com that is a USA based company so they can read your email and most of the .com, .net, net and al l other emails belong to the USA.
Even if you have for example a .se domain then the actually server can be in USA and then they can still legally read your email. So next time you send all your secrets in an email with no encryption please be aware of that someone will read it.
